Terms of Service

These terms govern your use of the DeliverBy app (“the Service”), operated by ampersandlane, based in the United Kingdom (“we”, “us”, “our”). By installing or using the Service you agree to these terms.

The Service

DeliverBy calculates and displays estimated delivery dates at your store’s checkout and lets you configure shipping rates by product group, dispatch schedule, cutoff times, shipping zone, and holiday days. Rates are returned to Shopify checkout as carrier-service options.

Account requirements

To use the Service you must maintain a valid Shopify account and comply with Shopify’s Terms of Service. You are responsible for the configuration you set up and for ensuring the rates and delivery estimates you publish are accurate for your business.

Billing

Paid plans are billed through Shopify’s billing system and renew automatically each billing period until cancelled. You can change plans or cancel at any time from within the app. Refunds are handled in accordance with the Shopify App Store refund policies. Prices are shown in the app and on the Shopify App Store listing.

Acceptable use

You agree not to use the Service for any unlawful purpose, to interfere with or disrupt the Service, to attempt to gain unauthorised access to it, or to use it in a way that infringes the rights of others.

Your content and configuration

You retain ownership of your store data and the configuration you create in the Service. You grant us the limited right to process it solely to provide the Service, as described in our Privacy Policy.

Data protection

We handle data in accordance with UK GDPR and the Data Protection Act 2018. See our Privacy Policy for details of what we collect and how it is used.

Availability and disclaimer

We aim to keep the Service available and accurate but provide it “as is” without warranties of any kind. Delivery date estimates are calculated from the settings you provide and are estimates only; we do not guarantee actual delivery times, which depend on your carriers and fulfilment.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential damages. Our total liability arising out of or relating to the Service is limited to the greater of the fees you paid in the twelve months preceding the claim, or £50.

Termination

You may terminate these terms at any time by uninstalling the app. We may suspend or terminate access if you breach these terms or if required to protect the Service or other users.

Governing law

These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
